2. Personal Data

Personal data is information about the factual or personal circumstances of a specific or identifiable natural person. This does not include statistical data that we collect, for example, when you visit our webshop and that cannot be directly linked to you.

Personal data, such as your name, address, telephone number, e-mail address, and other inventory data that you provide to us as part of your online registration, your order, your newsletter registration, and your request via our contact form, will be processed by us to the extent necessary to process your registration or order, your newsletter subscription, your use of the application, or to respond to your request.

We collect, store, and process your data associated with the webshop for the entire duration of the processing of your purchase or order, including subsequent warranties, for our services, and in accordance with the statutory retention periods (in particular for tax reasons). Newsletters and electronic advertising will be sent until you revoke this.

The purposes of data processing in detail:

3. Webshop

3.1. Online registration in our webshop

It is possible to shop in our webshop and use our product tracking list after you have registered online.

Your online access is password-protected. Here you can view information about your recently completed, pending, and shipped orders and manage your collected loyalty points, personal data, and newsletter subscription.

You undertake to treat personal access data confidentially and not to pass it on to unauthorized third parties. We cannot assume any liability for the misuse of passwords unless we are responsible for this. Please note that you will automatically remain logged in until you log out.

3.2. Procurement process

By completing your order online, you expressly authorize us to process the personal data you have provided in order to process your purchase and send your order to you. We need your e-mail address to confirm receipt of your order. We also use it for your identification (login on the website). In addition, you will receive a confirmation of your order and dispatch via your e-mail address. We also need your e-mail address and telephone number to contact you if you have any questions about your order or if there are any problems with the delivery.

3.2.1. Customer survey: We need your opinion

When ordering SelmiSwiss preparations, you will receive an invitation to participate in a voluntary customer survey 4 weeks after the purchase, from which you can unsubscribe at any time with effect for the future. The data obtained is evaluated anonymously and provides us with valuable information to further adapt our products to the needs of our customers and to support our scientific team.

4. Subscription to the Newsletter/Receipt of Electronic Advertising

By confirming the subscription to the newsletter, you voluntarily agree that SelmiSwiss GmbH may process your data for the purpose of sending electronic newsletters and receiving direct e-mails and personalized advertising about products, events, and services from SelmiSwiss. “Personalized advertising” means advertising that is tailored to you and your interests. We use existing information such as your place of residence, your registration date, and the customer group to which you belong in order to send you only advertising for products that you are really interested in.

You can only subscribe to receive the SelmiSwiss newsletter if you have given your express consent to do so. In order to send you the newsletter, we use the so-called double opt-in procedure, i.e. we will only send you the newsletter by e-mail if you have expressly confirmed to us that you wish to activate the service. We will then send you a notification e-mail and ask you to confirm that you would like to receive our newsletter by clicking on a link in the e-mail.

Newsletter provider: Mailchimp

We use Mailchimp, a service of The Rocket Science Group LLC, 675 Ponce de Leon Ave NE, Suite 5000, Atlanta, GA 30308, USA (hereinafter “Mailchimp”), to send newsletters. When you subscribe to our newsletter, the data you provide (e.g. your e-mail address) will be transferred to Mailchimp and stored on their servers in the USA.

Mailchimp acts as a data processor in accordance with Art. 28 of the GDPR and is bound by the standard contractual clauses approved by the European Commission, which guarantee an adequate level of data protection when transferring to third countries. For more information, please see Mailchimp’s privacy policy: https://mailchimp.com/legal/privacy/.

The data will be used exclusively for sending our newsletter and will not be passed on to third parties for commercial purposes. You can unsubscribe from the newsletter at any time via the link contained in each e-mail or contact us directly.

If you no longer wish to receive our newsletters, you can unsubscribe at any time via the link contained in each e-mail or contact us using the data provided in section 1.

5. Request via the contact form

If you send us a request via the contact form, the personal data provided will only be processed by SelmiSwiss.

Since requests via contact forms can be of different types, you must at least fill in the data marked as mandatory.

6. Registration data on the server

When you visit our website, your registration data is automatically collected and temporarily stored; however, it does not allow us to draw any conclusions about your person. This data includes, for example, browser type and version, the referring URL, the shortened IP address, the name of the provider, and the operating system used. All log data is evaluated by us or our service provider exclusively in anonymized form for statistical purposes, to improve our offer, to facilitate troubleshooting, and to defend against attacks on our webshop.

Website Security– Wordfence
This website uses the Wordfence Security plugin (Defiant Inc., USA) to protect against cyber-attacks and unauthorised access. Wordfence analyses traffic and may record IP addresses, login attempts and suspicious behaviour in order to detect and block malicious activity. These data are stored temporarily on the website server and are automatically deleted after a reasonable period. Processing is based on the controller’s legitimate interest (Art. 6(1)(f) GDPR) in ensuring the security and integrity of the website. International data transfers are carried out under the EU Standard Contractual Clauses (2021/914). For further details, see Wordfence’s privacy policy: https://www.wordfence.com/privacy-policy/

7. Cookies

In some areas, we use cookies to enable certain functions without which the shop would not function: shopping cart, wish list, comparison list, secure checkout, among others.

Cookies are small files that are stored locally on your hard drive and store certain settings and data that are exchanged with our system via your browser.

Most of the cookies we use are session cookies and are deleted from your hard drive after you close your browser. The long-term cookies we use remain on your hard drive for 30 days and are then deleted. When you visit us again, we automatically recognize that you have been here before and what entries and settings you prefer.

By using our website, you expressly declare that you wish to use our web service and that you accept the use of these cookies, to the extent that your browser allows this. Most browsers are set by default to accept all cookies. However, you have the option of setting your browser so that cookies are displayed before they are stored, that only certain cookies are accepted or rejected, or that cookies are completely rejected or deleted.

When you access our website for the first time, you will also see a banner or a cookie manager that allows you to accept, reject, or configure the use of cookies in detail before they are activated, in accordance with the applicable regulations. You can change your consent settings at any time via the same cookie management panel, which is accessible at the bottom of the website.

We would like to point out that configuration changes only affect the browser in which they are made. If you use other browsers or change your device, you must reconfigure your browser settings. In addition, you can delete cookies from your hard drive at any time. Information on setting, changing, and deleting cookies can be found in the help function of your web browser.

Further information about cookies can be found in the Cookie Policy.

Technical Cookies and External Services

In view of the constant increase in automated access attempts, malicious activities and the abusive use of forms by bots, we have found it necessary to introduce additional protection mechanisms to ensure the security of the website and its users.

  • Google reCAPTCHA: We use Google reCAPTCHA (v2 and v3) to protect our forms from spam and abusive access. This service may collect information such as your IP address, browsing behavior, and other technical data to verify that you are a human. These cookies are considered technical, although they may involve data transfers to the servers of Google LLC in the USA.
  • Google Fonts: Our website uses web fonts provided by Google. When you load the page, your browser establishes a direct connection to Google’s servers to download the fonts, which may involve the transmission of your IP address. Although no cookies are stored, this exchange is considered relevant from a data protection perspective. To further improve data protection for our users, we are working on a gradual transition to local hosting of all our fonts.

Both services are required for the operation and security of the website. If you do not agree with the use of these technologies, we recommend that you do not continue to visit our website.

If you would like to change your decision regarding the use of optional cookies, you can do so by clicking on the button below:

8. Tools for Advertising Tracking and Analysis (Google)

This website uses Google Analytics and Google Ads (Conversion Tracking), services of Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (“Google”), to analyze the use of the website and improve our digital marketing campaigns.

Google Analytics uses cookies to analyze user behavior on the website. We use the “anonymizeIP” function, in which IP addresses are shortened before storage or processing in order to exclude a direct personal reference. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA. The data collected will not be merged with other Google data.

Data associated with cookies, user IDs, or advertising is stored for a maximum of 14 months and then automatically deleted. You can prevent the use of cookies by making the appropriate settings in your browser or by downloading the add-on available at https://tools.google.com/dlpage/gaoptout.

We also use the Google Ads Conversion Tracking Service. When you click on a Google ad, a tracking cookie is placed on your device. These cookies do not contain any personal data and expire after 30 days. They enable us to create aggregated statistics about the effectiveness of our advertising campaigns.

The legal basis for the use of these tools is Article 6 paragraph 1 letter f of the GDPR, which is based on our legitimate interest in analyzing user behavior to optimize our website and our advertising campaigns.

9. Facebook Pixel/Remarketing/Retargeting

With your consent, this website uses tracking and remarketing technologies of the social network Facebook, operated by Meta Platforms Inc. 1601 S. California Ave. California Ave, Palo Alto, CA 94304, USA (“Facebook”). This includes the so-called conversion pixel, which makes it possible to track the actions of users after interacting with Facebook advertisements and to display personalized advertisements based on surfing behavior.

The information collected is anonymous from our point of view, so that we cannot individually identify users. However, Facebook may link this data to your user account and use it for its own purposes, as described in its privacy policy. This may enable Facebook and its partners to show you advertisements on and off the platform.

Facebook may store cookies on your device to enable this function. These cookies can track your behavior on this and other websites in order to display interest-based advertising (retargeting).

The use of these technologies is only activated when you have given your express consent via the cookie manager when you first access our website. You can revoke this consent at any time by changing your settings in the same cookie panel.

If you would like to manage your Facebook ad settings directly, you can do so at https://www.facebook.com/ads/website_custom_audiences/.
